1. Introduction

These terms and conditions govern your access to and use of thailandstorekw.com, related sites, mobile applications, and any services and tools (collectively referred to as the "Site") used in connection with providing the services mentioned in this User Agreement ("User Agreement" or "Terms and Conditions"). For the purposes of this User Agreement, thailandstorekw.com refers to Thailand Store for selling cosmetics, oud, and incense, including all branches and affiliated entities mentioned above.
Before becoming a member or continuing your membership on the Site, you must read and agree to this User Agreement and access all other relevant information referred to in this User Agreement, as it contains terms and conditions applicable to you as a user/member of thailandstorekw.com. This relevant information, including but not limited to the Privacy Policy, is incorporated by reference into this User Agreement.
2. Eligibility for
Membership thailandstorekw.com aims to ensure that its members can enter into legally binding contracts and ensure that minors do not purchase inappropriate content.
Therefore, membership is not available to persons under 18 years of age.
You must prove that you are 18 years or older before becoming a member of the Site. 3. Your Account and Registration Obligations

You also acknowledge the truth and accuracy of all the information you have provided.
4. When you become a member of the Site, you agree to:
A. Be responsible for maintaining the confidentiality of your account and password, restricting access to them, and being responsible for all activities that occur under your account and password.
You agree to notify thailandstorekw.com immediately of any unauthorized use of your password, account, or any other breach of security.

D. thailandstorekw.com has the right (at its discretion and at any time) to make any inquiries it deems necessary (directly or through a third party) and request additional information or documents, including but not limited to verifying your identity or ownership of your financial instruments. If the user is a business entity or registered on behalf of a business entity, such information or documents must include your business license, other incorporation documents, or documents proving the authority of any person to act on behalf of the business entity. You agree to provide any information or documents to thailandstorekw.com upon request. You acknowledge and agree that failure to provide the requested information or documents may lead thailandstorekw.com, without liability, to suspend or terminate your account or membership on the Site. Additionally, we reserve the right to suspend inactive or unverified accounts for a prolonged period.
5. Electronic Communications
You agree that thailandstorekw.com has the right to communicate with you via email, SMS, in-app notifications, or any other messaging app, or by sending notices on the Site. You agree that all agreed
communications provided to you electronically through any method satisfy the legal requirements as if such communications were in writing.
By accepting this User Agreement, you agree to authorize thailandstorekw.com to send promotional emails to notify you of any changes, new features, promotional activities, account updates, and any orders placed via thailandstorekw.com or any other information the site deems appropriate. If, at any time, you wish to stop receiving promotional emails, you can unsubscribe by clicking the link at the bottom of any promotional email or disabling notifications from the Site.
6. Amendments to this User Agreement
You acknowledge and agree that thailandstorekw.com will endeavor to notify you of any material modification to this User Agreement that increases your obligations or limits your rights under this User Agreement ("Material Amendment") in accordance with this User Agreement.
You also acknowledge and agree that thailandstorekw.com has the right, at its absolute discretion and without liability, to make any non-material modifications, which do not require your consent, at any time, and with immediate effect, by posting a notification of the modification on the Site or notifying you through any communication methods mentioned in clause 5 of this User Agreement.
7. Fees and Services

Unless otherwise stated, all fees and costs are payable in your local currency or the currency displayed on the Site when you place your order. You agree to pay all fees and costs applicable to the order you placed on the Site, including any returns, replacements, or applicable taxes or fees, to thailandstorekw.com or the appointed shipping agent.
8. Your Information

All content on the Site, including but not limited to text, graphics, logos, button icons, images, audio clips, video clips, digital content, data compilations, and software, is owned by thailandstorekw.com or its content suppliers or licensors and is protected by intellectual property laws, trademark regulations, patents, or other laws governing intellectual property rights. All content of this Site is the exclusive property of thailandstorekw.com and is protected under copyright laws, trademarks, patents, or other intellectual property regulations.
11. Trademarks
thailandstorekw.com and related logos, words, and other marks listed or published on the Site are either unregistered or registered trademarks of thailandstorekw.com, protected under international trademark regulations and other intellectual property laws.
thailandstorekw.com trademarks may not be used concerning any product or service that does not belong to thailandstorekw.com or in any way that disparages or discredits thailandstorekw.com.
All other trademarks not owned by thailandstorekw.com that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by thailandstorekw.com.
12. Reporting Abuse on thailandstorekw.com
You must report any violations or potential violations of this User Agreement to thailandstorekw.com using the contact information provided on the Site.
If you believe that your intellectual property rights have been infringed, please notify thailandstorekw.com.
Without prejudice to any other rights or remedies of thailandstorekw.com under this User Agreement or by law, thailandstorekw.com has the right to restrict, suspend, or block access to the Site or terminate the user's membership if they violate or potentially violate any intellectual property rights.
thailandstorekw.com also has the right to take technical or legal measures against users causing problems or engaging in potential legal violations or behavior that contradicts this User Agreement or our policies.
13. Returns/Exchanges
When returning or exchanging a product sold on the Site to thailandstorekw.com, you agree to the following:
A. You must request a return within two days of delivery or within the period required by applicable laws or regulations issued by the relevant authorities.
B. You must fill out the "Return Form" attached to your original order or as published on the Site and attach it to the returned package or as instructed on the Site.
Pack the product securely (in the original package) with all labels, brand packaging, unused, and in its original condition as delivered to you.
C. You must contact us through the customer service phone, WhatsApp, or other contact details provided on the Site, and request a return/exchange and confirm the pickup location. A pickup date will be arranged with a delivery agent to collect the package from you.
D. Your return will be processed upon the product's arrival, and thailandstorekw.com will send a confirmation via email/SMS. The refund/exchange is subject to successful quality inspection of the returned product per thailandstorekw.com's policies and standards. Upon receipt, the returned product is verified within 24 hours or the specified timeframe on the Site. The product's credit is added either as a store credit or a bank account deposit as chosen by you or in accordance with the applicable terms and conditions.
The time to transfer the refund to your account may vary and is determined by the issuing bank. Please contact the issuing bank for details on refund procedures if you experience delays in receiving your refund processed by thailandstorekw.com.
E. In case of an exchange request, it is carried out in two steps:
1. Store credit will be created for the returned product(s). Returning the product is subject to clause 13 of this Agreement.
2. A new order will be placed for the product(s) to be exchanged as per clause 13 of this Agreement.
F. If the product is damaged or used after being sent by thailandstorekw.com, or for health reasons, thailandstorekw.com reserves the right to accept or reject the return or exchange of this product.
G. The user bears the costs, expenses, taxes, and all related fees for product exchange/returns.
14. VAT (Value Added Tax)
VAT is a transaction-based tax and applies to certain products sold by thailandstorekw.com in accordance with the laws, rules, and regulations applicable in the country of fulfillment or final delivery.
By accepting this Agreement, you agree to bear the cost of VAT, or any taxes, fees, or other charges related to fulfilling the order from the point of supply to the place of delivery.
As a rule, the transaction will be supplied from where the products are located when the supply begins for delivery to the customer.
A. Order Fulfillment from Outside Your Country Some or part of your order may be fulfilled from thailandstorekw.com or its affiliate company registered, based, or located outside your country. In such cases, thailandstorekw.com will provide you with an estimate of applicable import fees, taxes, and other fees incurred or likely to be incurred during fulfillment ("Import Fees"). By accepting this User Agreement, you authorize thailandstorekw.com or its service partners, including the appointed delivery agent, to use the import fees and pay any applicable taxes or fees on your behalf to the relevant authorities in the country of supply or final delivery. You agree that paying import fees is your responsibility as an importer and is imposed according to the laws of the country where the products are shipped. Import fee deposits vary depending on the shipping method specified and are only an estimate of taxes, fees, and costs that may be applied, not an actual calculation.
thailandstorekw.com or its affiliate will be responsible for delivering the order to the specified shipping company outside your country at the point of supply and will not act as a customs clearing agent or delivery agent on your behalf.
You agree that in this case, thailandstorekw.com's responsibility ends once the goods are dispatched, and you or the appointed delivery agent are responsible for the successful and timely delivery and safekeeping of the dispatched goods from the point of supply to your specified delivery address. You also agree that thailandstorekw.com will not be liable for any delivery delays, damage, loss of goods, or any other issues after dispatch from its warehouses.
B. Order Fulfillment from Your Country: If an order is fulfilled from your country, meaning that the goods are in your country when shipping begins, thailandstorekw.com or its affiliates will collect applicable taxes (including VAT) in accordance with applicable laws. The estimated tax amount will be collected from you and deposited with the relevant authorities in accordance with applicable regulations.
15. Limitation of Liability
• thailandstorekw.com will not be responsible for unsatisfactory, delayed performance, or losses, damage, or delays due to products being unavailable or becoming unavailable.
• thailandstorekw.com makes no representations or warranties regarding the characteristics (including but not limited to quality, value, or marketability) of the products proposed for sale or purchase on the Site.
• thailandstorekw.com will not be liable for any errors or omissions on the part of third parties.

Without prejudice to any other rights or remedies of thailandstorekw.com under this User Agreement or by law, thailandstorekw.com may, at any time and without legal liability, restrict your activity, cancel your membership, withdraw it, or restrict, or withdraw your access to the Site if:
• You breach this User Agreement.
• thailandstorekw.com cannot verify any information provided.
• thailandstorekw.com (at its sole discretion) believes that any of your actions may cause legal liability for you, other users, or thailandstorekw.com.
• thailandstorekw.com has reasonable grounds to believe that you have violated any of the restrictions set forth in this User Agreement.
• thailandstorekw.com suspects fraudulent activity or behavior in the account from your side.
thailandstorekw.com reserves the right to suspend users whose accounts have been suspended indefinitely. A user whose membership has been suspended or withdrawn indefinitely cannot register or attempt to register on thailandstorekw.com or use the Site in any way unless the membership is reinstated by the Site. Notwithstanding the preceding, in case of a breach of this User Agreement, thailandstorekw.com reserves the right to recover any amounts owed to thailandstorekw.com and any losses or damages caused by you directly or indirectly and may take legal action or initiate criminal proceedings against you as deemed appropriate at thailandstorekw.com's discretion.
Failure by the Site to take any action regarding any violations by you or others does not waive thailandstorekw.com's right to take any action concerning these violations or any subsequent or similar violations.
thailandstorekw.com does not guarantee action against all potential breaches of these Terms of Use.
18. Blocking Access to the Site and/or Termination of Membership
Without prejudice to any other rights or remedies of thailandstorekw.com under this User Agreement or by law, thailandstorekw.com reserves the right to restrict, suspend, or terminate your membership and/or restrict your access to the Site at any time without notice for any reason, including but not limited to a breach of these Terms of Use.
19. No Warranty
thailandstorekw.com provides the Site and its services on an "as is" and "as available" basis without any representation, endorsement, or warranty, or assurance of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, compatibility, security, accuracy, and non-infringement.
thailandstorekw.com makes no representations or warranties about the accuracy, reliability, or completeness of any content, information, software, text, images, links, or communications provided on or through the use of the Site, or that operations on the Site will be error-free or uninterrupted.
thailandstorekw.com does not warrant that defects will be corrected or that the Site or its servers are free of viruses or anything else that may be harmful or destructive.
Due to the nature of internet communications, this Site may be subject to data corruption, interruption, non-availability, and delays.
The Site may also be unavailable from time to time due to repair, maintenance, or development work.
You agree that thailandstorekw.com is not obligated to provide support for the Site.
You expressly agree to use the Site at your own risk.
20. Limitations of Liability
To the extent permitted by law, thailandstorekw.com and its officers, employees, agents, affiliates, and suppliers will not be liable for any loss or damage of any kind, whether direct or indirect, incidental, special, consequential, or exemplary, including but not limited to losses, damages, loss of profits, goodwill, business, missed opportunities, data, or other intangible losses arising from or related to your use of the Site, its services, or this User Agreement, regardless of the cause, including negligence or otherwise, whether thailandstorekw.com has been advised of the possibility of such losses or damages.
If you are dissatisfied with the Site, its content, or materials on it, your sole exclusive remedy is to stop using it. Additionally, you agree that any unauthorized use of the Site and its services resulting from your negligence or carelessness will cause irreparable harm to thailandstorekw.com, and thailandstorekw.com will treat any unauthorized use as a violation of the Terms and Conditions of this User Agreement.
21. Indemnity
You agree to indemnify thailandstorekw.com, its affiliates, officers, employees, agents, and suppliers and hold them harmless from any and all claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable legal costs and expenses) arising from your violation of this User Agreement, any law, or the rights of thailandstorekw.com or any third party.
22. Relationships and Notices
The terms of this User Agreement do not create a partnership, agency, or joint venture between you and thailandstorekw.com, and you do not have the right to bind thailandstorekw.com in any manner.
23. Disputes
If any dispute, claim, disagreement, or controversy (including but not limited to any complaints related to damages or legal aspects) ("Dispute") arises from or relates to this User Agreement, including (but not limited to) any question concerning information, entity, jurisdiction, performance, interpretation, validity, termination of this User Agreement, or any question regarding the legal relationships created by this User Agreement, or consequences of its invalidity, the parties must first attempt to resolve the Dispute amicably through good faith negotiations over a thirty (30) calendar day period beginning on the date one party first sends a written notice of the Dispute to the other party.
24. Assignment of Rights and Obligations
You hereby grant thailandstorekw.com the right and irrevocably acknowledge that thailandstorekw.com has the right at any time to transfer all or part of its rights, privileges, obligations, or liabilities (whether express or implied) under this User Agreement to any of its affiliates or any other party without requiring additional consent from you. In such cases, thailandstorekw.com agrees to make reasonable efforts to notify you of the transfer by posting on the Site or other means of communication mentioned in clause 5 of this User Agreement. You may not transfer all or part of your rights, privileges, obligations, or liabilities (whether express or implied) under this User Agreement to any person at any time without prior written consent from thailandstorekw.com.
25. General Provisions
If any provision of this User Agreement is found to be invalid, void, or unenforceable for any reason, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions of this User Agreement.
This User Agreement (as amended from time to time in accordance with this User Agreement) constitutes the entire understanding and full agreement between you and thailandstorekw.com regarding the subject matter herein.
No person who is not a party to this User Agreement has the right to enforce any term of this User Agreement. If this User Agreement is translated into any language other than English, whether on the Site or otherwise, only the English text shall be relied upon.
26. Governing Law
For orders fulfilled by Thailand Store Kuwait, the terms and conditions of this User Agreement are governed and interpreted in accordance with the laws of Kuwait.
This clause shall remain in effect following the termination or cancellation of this User Agreement for any reason.
